SB 326 for Homeowners Associations
The new law, SB 326, is specific to condominiums where Homeowners Associations control through an elected board of directors. This board is responsible for maintaining and managing the buildings, which includes receiving an inspection and ensuring all decks and balconies are up to safety requirements. As of January 2020, all condominiums that meet this standard will need a professional inspection to avoid financial penalties.
A qualified waterproofing expert, architect, or engineer will perform a visual inspection of the deck including:
- Waterproofing
- Flashing systems
- Drains
- Doors
- Siding
- Railings
- Stairs
- Handrails
- Mounting plates
- Stucco
- Beams
- Structural supports
After the inspection, a final report must also be submitted to the Homeowners Association. This report will include an overview of the current condition of the balcony or deck, as well as any elements that need repairing, and the estimated life expectancy.
